Please read these Terms of Service (“Terms”, “Terms of Service”) carefully before using the DialZara service (the “Service”) operated by Dialzara LLC ( the "Company" “us”, “we”, or “our”). Your access to and use of the Service is conditioned upon your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who wish to access or use the Service. By using the Service, you signify your understanding of and agreement with these Terms. The Customer’s continued use of the Service constitutes their ongoing acceptance of these Terms. If you disagree with any part of the Terms, then you do not have permission to access the Service.
By filling out a form on our website, or by creating an account, you expressly agree to be contacted by phone number, text message (reply STOP to op-out), e-mail, for marketing purposes from Dialzara LLC. You may opt-out of receiving further communication by emailing contact (at) dialzara.com.
When you create an account with us, you guarantee that the information you provide us is accurate, complete, and current at all times. Inaccurate, incomplete, or obsolete information may result in the immediate termination of your account on the Service. You are responsible for maintaining the confidentiality of your account and password, including but not limited to the restriction of access to your computer and/or account. You agree to accept responsibility for any and all activities or actions that occur under your account and/or password, whether your password is with our Service or a third-party service. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
The Service and its original content, features, and functionality are and will remain the exclusive property of www.Dialzara.com and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.
By using the Service, you understand that the AI-powered virtual agent is a tool designed to assist with business communications. However, the Company makes no guarantees regarding the accuracy, appropriateness, or completeness of the responses given by the AI agent. By using the service, you acknowledge that there may be instances where the AI agent provides incorrect or misleading information about your business. The Company shall not be held liable for any such inaccuracies or misrepresentations.
By using the Service, you acknowledge that the effectiveness and accuracy of the AI receptionist are contingent upon the quality and relevance of the training data provided by you. You agree to provide accurate, appropriate, and comprehensive information to train the AI receptionist. The Company is not responsible for errors, inaccuracies, or inappropriate responses generated by the AI receptionist that are a direct result of inadequate or incorrect training data supplied by you.
By using the Service, you agree that the Company may use recordings of interactions with the AI agent for the purpose of improving the Service. These recordings will be used solely for training and quality improvement of the AI agent. You acknowledge that all such recordings will be handled with strict confidentiality.
The Company commits to not sharing any recordings of interactions with the AI receptionist with third parties, except as required by law or as necessary for the operation and maintenance of the Service. The Company will take reasonable measures to ensure the security and privacy of these recordings.
By signing up for a subscription plan, you agree to pay the associated fees, as indicated on our pricing page. All subscription plans include a 7 day free trial. Billing commences exactly 7 days after you begin the free trial. You may cancel anytime during the free trial without penalty. All fees are due on a recurring basis, according to your selected plan’s billing cycle. We reserve the right to modify our pricing at any time. You will be notified of any changes to pricing at least 30 days in advance. No refunds will be processed for any prior billings.
We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms. If you wish to terminate your account, you may cancel your account anytime through our online billing portal or contact us with a request for termination. All provisions of the Terms which, by their nature, should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
In no event shall Dialzara, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Service.
These Terms shall be governed and construed in accordance with the laws of the State of Idaho, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service and supersede and replace any prior agreements we might have had between us regarding the Service.
We take the privacy and security of your data seriously. By using the Service, you agree to the collection and use of information in accordance with our Privacy Policy. We implement reasonable security measures to protect your data, but we cannot guarantee absolute security. You are responsible for maintaining the security of your account credentials and for any activities that occur under your account.
Depending on your selected subscription plan, we will provide you with varying levels of support for the Service. We will make reasonable efforts to ensure the Service operates as intended, but we cannot guarantee error-free performance or uninterrupted availability. We reserve the right to perform maintenance and updates to the Service, which may occasionally result in temporary downtime.
